Terms of Use
1. About these terms
These Terms of Use ("Terms") govern your use of the FITRIA mobile app, its Apple Watch app, widgets and related services (the "Service") provided by FITRIA ("we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
The Apple Standard Licensed Application End User License Agreement (EULA) also applies to your use of the app: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.
2. Not medical advice
FITRIA provides general fitness and nutrition information, workout programs, meal plans and estimates (for example calories, macros or starting weights). This content is for informational purposes only and is not medical advice, diagnosis or treatment.
Consult a doctor before starting any exercise or diet program, especially if you are pregnant, have a medical condition, an injury, or take medication. Stop exercising immediately if you feel pain, dizziness or shortness of breath. You exercise at your own risk.
3. Automatically generated content
Some content (personal plans, recipes, food recognition from photos, product label reading, texts and images) is generated automatically. It may contain mistakes. Always check numbers such as calories, ingredients and allergens yourself before relying on them.
4. Your account
You must be at least 16 years old to use the Service. You are responsible for the accuracy of the information you provide and for keeping your login credentials secure.
You can delete your account at any time in Settings → Delete my account. This permanently deletes your profile and associated data as described in our Privacy Policy.
5. FITRIA Premium subscription
Some features require a paid auto-renewable subscription ("Premium"). Prices are shown in the app before purchase and may vary by country.
Payment is charged to your Apple ID account at confirmation of purchase. The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period at the price of the chosen plan.
If a free trial is offered, it converts to a paid subscription at the end of the trial unless cancelled at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription.
You can manage or cancel your subscription in your Apple ID settings (Settings → [your name] → Subscriptions) or from Settings in the app. Deleting the app does not cancel a subscription. Refunds are handled by Apple under its policies: https://support.apple.com/en-us/118223.
6. Acceptable use
You agree not to misuse the Service: do not break the law, upload illegal or offensive content, attempt to access other users' data, reverse-engineer the app, overload our servers or resell the Service.
7. Content and intellectual property
The app, its design, programs, texts, images and software belong to us or our licensors. We grant you a personal, non-exclusive, non-transferable licence to use the app for private, non-commercial purposes.
Content you add (for example photos, notes, logged meals) remains yours. You grant us the right to store and process it to provide the Service to you.
8. Health data
If you connect Apple Health, the app reads the data you allow (for example steps, heart rate, workouts, body weight) and may write workouts. Health data is used only to provide app features to you and is never used for advertising or sold.
9. Availability and changes
We work to keep the Service available but do not guarantee that it will be uninterrupted or error-free. We may change, add or remove features. If a change materially reduces paid features, we will inform you in advance.
10. Limitation of liability
To the maximum extent permitted by law, the Service is provided "as is" and we are not liable for indirect or consequential damages, injuries resulting from exercise or diet, or loss of data. Nothing in these Terms limits liability that cannot be limited by law, including your statutory consumer rights.
11. Termination
We may suspend or terminate accounts that violate these Terms. You may stop using the Service at any time.
12. Changes to these Terms
We may update these Terms. The date at the top shows the latest version. If changes are significant, we will notify you in the app. Continued use after changes means you accept them.
13. Governing law and contact
These Terms are governed by the laws of Ukraine, without prejudice to mandatory consumer protection rules of your country of residence.
